Divorce Process Explained
Requirements for using our divorce services
- You have been married for at least one year.
- One of you is either resident or domiciled in England and Wales.
What ground should I use?
- 2 years separation by consent
- Have to have been separated for 2 years and both parties agree to
the divorce.
- 5 years separation (no consent)
- Have to have been separated for 5 years , you do not
require your spouses consent. If you do not know where
they are, you can still divorce them.
- Adultery - Your spouse has had sexual
intercourse with someone else during the marriage and you
have not lived together for more than 6 months since
finding out about it.
- Unreasonable behaviour - Your spouse has
behaved in a way that you feel it has causes the marriage
to break down.
- Desertion - Your spouse left you for no
reason more than 2 years ago and there has been no reconciliation.
What happens next?
- A petition is filed at court setting out the ground for
the divorce with the court fee.
- The court then send a copy of the petition to your
spouse with an acknowledgment form for them to complete
and return to the court.
- The court will then send a copy of the form to you.
You can then apply for the Decree Nisi (the first
decree).
- The court will issue a certificate telling you when the
Decree Nisi will be pronounced in court
- 6 weeks after the Decree Nisi you can then apply to make
the Decree Nisi Absolute (the final decree).
- The whole process takes about 3-4 months to conclude.
